The Exchange Legal Status

The Exchange's legal status is unique and complex. As a non-appropriated fund instrumentality, the Exchange enjoys the same sovereign immunity as the rest of the government. However, not every federal regulation applies to the Exchange, even those that apply to installation MWR / Services activities. The Exchange also has internal policies and procedures that may or may not be similar to MWR / Services or other non-appropriated fund activities. Different legal principles apply to the Exchange contractors.
